Recently, in order to further enhance the professional qualities of young lawyers and promote the specialization of the law firm, Allwell Legal Sydney Office successfully organized an exciting mock court activity. In this event, lawyers demonstrated excellent debating skills and solid legal knowledge through simulating a real courtroom trial process.
The mock court was presided over by Lawyer Yang Zherui, the director of Allwell Legal Sydney Office, with Lawyer Zhou Yiqun acting as the plaintiff’s attorney, and legal assistants Cheng Cheng and Li Jingyuan assuming the roles of the defendants.
At the beginning of the activity, participating lawyers took their seats according to the roles they played, such as judges, plaintiff's attorneys, defendant's attorneys, and witnesses. Unlike the trial system in domestic courts, the Anglo-American legal system follows an adversarial trial model, where the proceedings and pace of the trial are controlled by the parties involved. The disputed focus of the case is presented to the judge by the disputing parties themselves. The judge spends most of the time listening to the arguments from both sides and then makes an independent judgment. Therefore, after the trial began, the parties engaged in processes such as presenting evidence, cross-examination, and courtroom debates. Based on existing materials and their solid legal knowledge, they engaged in professional clashes revolving around the disputed points of the case and reached professional conclusions.
After the trial concluded, the parties involved revisited the disputed points of the case and reflected on the issues that arose during the trial process. Finally, Lawyer Yang Zherui provided feedback and guidance on the performance of the parties involved. Drawing from her practical experience, she shared key points and techniques related to courtroom strategies with the young lawyers and interns who participated in the mock trial.
This mock court activity, as an innovative form of training, allowed lawyers to assume different roles during the simulated litigation process. When facing real legal issues, they showcased their exceptional talents and professional legal qualities. This not only provided lawyers with an opportunity to hone their skills in a realistic setting but also created a platform for enhancing practical abilities and engaging in academic exchanges.
